Quizera – Terms and Conditions

1. Welcome to Quizera

In these Terms, Quizera means the service operator identified in the data controller section of the Privacy Policy.

These Terms apply to your use of Quizera Services and our Platform, and we recommend that you read them carefully. Please also see the definitions given at the bottom of this page. The Terms and our Acceptable Use Policy, applicable guidelines and any additions related to any Service Plan create a legal Agreement between you and Quizera for your use of Quizera Services.

These Terms define the terms and conditions under which you are permitted to use Quizera Services and consume Resources. If you do not agree to these Terms, you should immediately stop using Quizera Services and Resources.

In addition to these Terms, our Privacy Policy and Cookie Policy explain how we may process personal information we may collect when you use Quizera Services and how we protect your privacy.

1.1 International Use

Quizera Services are available worldwide, but must be used in accordance with the laws of your jurisdiction. These Terms are interpreted in accordance with the mandatory consumer protection laws of your jurisdiction. Special provisions for users in the European Union, United States and other jurisdictions are included in this document.

2. Responsible Use and Behavior

2.1 Age Limit and Parental Consent

The minimum age for the Services is 13, or 16 for EU/EEA users. These are Quizera's service limits; stricter local age or additional consent requirements still apply. We do not offer participation below these limits through parental consent. If we identify data belonging to a user below the age limit, we initiate account closure and erasure of the relevant data. 2.2 General Usage Rules

You agree to use Quizera Services and Resources only for their intended purposes, as permitted in the Agreement and in accordance with applicable laws. If you use Quizera Services in a way that violates the Agreement or applicable laws, we may terminate your account and/or suspend your use of Quizera Services. Whether personal or professional, your account is personal and for your use only, and your account may not be shared with or used by others.

You are responsible for maintaining the confidentiality of your account and authentication credentials related to your use of Quizera Services that are not publicly available. You must immediately notify us of any potential misuse of your accounts, authentication credentials, or any security incident related to your Quizera Services.

By registering for an account, you represent and warrant that the information you provide is accurate and that you will not misrepresent personal information or provide false information about your identity in connection with your use of the Services. Quizera reserves the right to take legal action against individuals who misrepresent personal information or otherwise provide false information about their identities in connection with the use of the Services. Notwithstanding the foregoing, you acknowledge that Quizera cannot guarantee the accuracy of any information submitted by any user or verify the identity of any user who chooses to use the Services. We are not obligated to verify any user's identity.

3. Your Licensed Rights

Quizera Services and Resources are the property of Quizera and (where applicable) Quizera's content license holders. Under the Agreement, we grant you a limited, non-exclusive, revocable license ("License") to use Quizera Services and Resources.

Our Free Service Plans allow use only for non-commercial purposes. If you wish to use Quizera Services and Resources for professional or commercial purposes, you must have a Paid Service Plan. In any case, unless expressly authorized by Quizera in an agreement or under your Service Plan, you are not permitted to use Quizera for advertising, marketing or sales activities. You agree to comply with our Acceptable Use Policy and other user policies that apply at all times to your use of Quizera Services and Resources.

Except for the rights expressly granted in the Agreement, Quizera does not grant you any right, title or interest in any Quizera Service or Resources. For the avoidance of doubt, you may not charge any fees or request payment in connection with your use of the Service or Resources unless expressly permitted by Quizera.

All trademark signs displayed on Quizera are the sole property of Quizera or its licensors. The Agreement does not grant you the right to use any trademark sign for any purpose, whether commercial or not.

Quizera Services reserves the right to upgrade and/or modify at any time. Version updates may be regularly communicated to you via your registered email address, in-app or in-service notifications, or push notifications. To receive push notifications, you may need to grant notification permissions from your device settings. If you do not grant notification permission, important updates will be delivered via email or in-app notifications.

4. Quizera Service Plans

Quizera services are available under different Service Plans. You can find details of available Service Plans within our application. These Plans can be divided into the following categories:

i Free Service Plans: Our Free Service Plans provide access to a limited set of features in Quizera Services. Free Service Plans may only be used for non-commercial purposes.

ii Paid Service Plans (Quizera+): Our Paid Service Plans provide access to more functions and features. Paid Service Plans are permitted to be used in professional and commercial environments such as education, surveys and events for both internal and external audiences. Available features and functions depend on the plan type. Each plan has limits in terms of license and number of participants. Our Paid Service Plans consist of two tiers, Quizera+ (Plus) and Quizera Pro; the tiers differ in AI quiz creation allowance, number of questions per quiz and live game participant limits, and the current limits are shown inside the application.

Service Plans vary according to the Quizera Service you choose to subscribe to, and the content and features of a Service Plan may vary depending on when you register and register through the application. Information about different Service Plans can be accessed from within the application.

You can manage your Service Plans from your Quizera user account. If you purchased a Paid Service Plan from a distribution platform such as Google Play or Apple App Store, you must manage your account from these platforms.

5. Payments, Cancellations, Upgrades

5.1 General

Paid Service Plans can be purchased through our application or from third parties (Google Play, Apple App Store). The provisions of this section apply whether you register for one of our Paid Service Plans directly from us through our application or from third-party platforms.

You represent and warrant that your registration information, payment details (if you have registered for a Paid Service Plan) and all other information you provide to us is accurate, error-free and complete, and you agree to keep it that way at all times. If you have provided incorrect or inaccurate information, you should return to the login screen or correct this information in your account settings. You represent and warrant that you will not allow anyone else to use or access your account or exercise the rights granted to you under the Agreement.

5.2 Payments and Subscription Periods

All Paid Service Plans will be paid in advance at the beginning of each Subscription Period, are non-refundable and, to the extent permitted by applicable laws, are not subject to refund.

Your fee will be collected before access to your Paid Service Plan is granted. At the end of your current Subscription Period, your Paid Service Plan will automatically renew and you will be charged for the next Subscription Period according to your registered payment information.

If you do not pay for your Paid Service Plan on time, Quizera reserves the right to suspend your Quizera account or remove Paid Service Plan features.

5.3 Right of Withdrawal

If you are a Consumer, you have the right to cancel your Service Plans depending on your jurisdiction:

If you wish to exercise your right of withdrawal, please send us your cancellation request within the 14-day period. If the 14-day period ends on a Saturday, Sunday or any public holiday, the period is extended until the next business day.

If your cancellation is made within the 14-day period, it is considered timely. The responsibility for proving that you made the cancellation on time lies with you. Therefore, you must cancel in writing. You can use cotyora@gmail.com to cancel your subscription.

You may test the Services to determine their structure, features and functions before exercising your right of withdrawal. We cannot charge you for exercising your right of withdrawal and we will refund all payments you made to Quizera for the Services without undue delay.

However, if you are a Consumer who purchases digital content, you lose your right to withdraw and receive a refund because you gain immediate access to the content. You will be asked to consent to the immediate provision of Services during the purchase process and to acknowledge that your right of withdrawal is therefore not applicable.

5.4 Cancellations

If you do not wish to renew your Subscription Term for a Paid Service Plan, you have the right to cancel your Paid Service Plan before your current Subscription Term ends. If you are a consumer in Turkey, we will notify you of your right to cancel via email to your registered email account or through in-app or in-service notifications every six months during your Subscription Period. You can cancel by notifying our email address. Any cancellation will take effect on the first day after the last day of your current Subscription Term. Upon cancellation, your access to Paid Service Plan features ends and your subscription is downgraded to a Free Service Plan.

5.5 Version Upgrades and Downgrades

You may upgrade or downgrade your Paid Service Plan subscription to a different Paid Service Plan at any time. If you downgrade your subscription to a lower-level Service Plan, this downgrade will take effect on the day after the last day of the current Subscription Period. If you upgrade your subscription to a higher-level Service Plan, the upgrade takes effect immediately upon payment of the relevant upgrade fee.

After your upgrade, your Paid Service Plan will be subject to the new subscription terms. Any remaining time under your previous Paid Service Plan will be credited to you.

5.6 Price Changes and New Service Plans

Quizera may change the price of a Paid Service Plan. If such a price change occurs for you, it will not take effect until the start of your next Subscription Period. Your continued use of Quizera Services means you accept the price change. If you do not agree to price changes, you have the right to reject the change by canceling your subscription before your next Subscription Period renewal.

We do not make any refunds if the price of a Paid Service Plan decreases or if we later offer promotional prices or if we change the content or features of the Service Plan.

Quizera may decide to change or discontinue our Service Plans. If the Service Plan you subscribed to is changed or replaced by another, your subscription will automatically be on the Service Plan corresponding to the price of your original plan unless you choose to upgrade your subscription.

5.7 Trials

We may, at our sole discretion, grant you a Trial. We reserve the right to cancel the Trial and suspend your account if we determine that you are not eligible. Separate terms and conditions may apply when using a Quizera Service under a Trial, including restrictions on available features or usage areas.

For some Trials, we require you to provide payment information to start the Trial. In such cases, your Trial will automatically convert to a paid subscription for the selected Service Plan from the first day after your Trial period ends. We will use the payment details you provided when you started the Trial to charge you. If you do not want to continue using the Service Plan you selected with a paid subscription, you must cancel your subscription before the Trial period ends.

5.8 Prepaid Subscription Codes

If you have received a Code, the separate terms and conditions that come with the Code regarding your access to the Service will also apply, and you agree to comply with these terms and conditions.

Paid subscription Codes purchased from third parties or through other platforms (e.g., Google Play or Apple App Store) are subject to those platforms' refund policies. Quizera cannot be held responsible for these platforms' policies.

5.9 Taxes

List prices may not include sales or value-added tax, and relevant tax may be calculated and added at the time you complete the transaction, and this tax may not be visible to you until you receive a receipt for your purchase transaction, depending on where you make the purchase. In certain jurisdictions, local laws cover all relevant taxes, in which case they are shown at the time of purchase.

6. User Guide

6.1 Quizera's License to User Content

User Content is only visible to you and is kept with limited visual content and is used by Quizera only for the purpose of providing the Services and Resources. We will keep all data you provide to the Services, including all types of User Content, secure and will only process your data for the purpose of providing Quizera services to you.

6.1.1 Data Retention and Deletion

Quizera stores quiz content and other User Content you create until you delete the quiz or delete your account. However, Public User Content (public quizzes) is an exception to this rule. Public quizzes may remain accessible by other users on the platform or backup copies may be stored even if deleted by the quiz owner. Quizera reserves the right to delete content at any time for technical reasons, legal requirements, or in case of Agreement violation. When you delete your account, your private quizzes and personal data are deleted, but your Public User Content may remain on the platform.

By this document, you grant Quizera a worldwide, non-exclusive, time-limited license to access, use, process and display User Content to the extent reasonably necessary for the following purposes: (a) to provide, maintain, update and improve the Services, including the development of new features and services related to the Services; (b) to prevent or resolve service, security, support or technical issues; (c) as required by law; and (d) as expressly permitted by you.

Quizera will delete all User Content from your account upon termination of the Agreement, except for Public User Content (if any) permitted to Quizera as described herein or in accordance with the Quizera Privacy Policy.

6.2 Your Responsibility for User Content

Regarding any User Content you publish on Quizera (including quizzes, questions, answers, images, descriptions and all other content): (1) You represent and warrant that you have all necessary rights to upload this User Content to the Quizera Service and to grant the above permission to Quizera, and (2) you represent and warrant that this User Content or its use by Quizera does not violate the Agreement, applicable law, or (including but not limited to copyright) the intellectual property, reputation, personality or other rights of others.

You are solely responsible for all User Content you publish on Quizera (including quiz content). Quizera does not endorse or guarantee the accuracy, reliability, currency or suitability of User Content, quiz content, or any opinions, questions, answers or information contained in User Content. You are solely responsible for any liability arising from the use of quiz content for educational, examination or assessment purposes.

6.3 Monitoring and Moderation of User Content

Unless we have agreed otherwise in a separate agreement with you, Quizera may review, monitor, edit or remove User Content but is not obligated to do so. Quizera reserves the right to remove or block access to all User Content that violates the Agreement, including the Acceptable Use Policy and Editorial Guidelines, in any case. Removal of User Content or disabling access is entirely at our discretion.

Quizera is not obligated to continuously monitor or moderate content on the platform. However, content reported (Report) by users is reviewed by management. When a complaint is made about a quiz or content, Quizera management has the right to review and, if deemed necessary, remove, modify or block access to the content. The complaint process is subject to Quizera's unilateral discretion, and Quizera is under no obligation to remove or not remove reported content.

6.4 Public User Content

If you choose to make User Content Public User Content, you grant Quizera (or for as long as permitted by applicable law) a non-limited, sublicensable, transferable, royalty-free, irrevocable, fully paid, worldwide license to market, use, reproduce, make publicly available (e.g., application or display), publish, translate, modify, and create derivative works from your Public User Content, in any form or medium now known or hereafter developed, method or technology, alone or together with other content or materials.

7. Quiz Content and Disclaimer

7.1 Accuracy of Quiz Content

All quiz content (including questions, answers, descriptions and other materials) created, shared or used on the Quizera platform is created by users or generated using artificial intelligence technologies. Quizera does not guarantee the accuracy, currency, completeness or suitability of any quiz content on the platform. Quizera has no responsibility regarding the accuracy, reliability or suitability of quiz content.

7.2 AI-Generated Content

Quizera offers quiz content creation features using artificial intelligence technologies. AI-generated content is automatically produced, and Quizera does not guarantee the accuracy, suitability or reliability of such content. AI-generated content may be erroneous, incomplete, inappropriate or misleading. It is recommended that you check and edit such content at your own discretion before use.

7.3 Educational and Examination Use

Quizzes on the Quizera platform are for educational, entertainment and informational purposes. Quizera accepts no responsibility if these quizzes are used for official examinations, certification programs or academic assessments. Any damage, loss or liability arising from the use of quiz content for official examination or assessment purposes is entirely the user's responsibility.

7.4 Quiz Content Liability

You are solely responsible for all quiz content (including questions, answers, images, descriptions) that you create, share or publish on the Quizera platform. If your quiz content constitutes copyright infringement, personality rights violation, defamation, misleading information or any other legal violation, all legal liability belongs to you. Quizera cannot be held responsible for any claims, lawsuits or damages arising from quiz content created by users.

7.5 Copyright Infringement Notice

If you believe your copyright has been infringed on the Quizera platform, you may file a copyright infringement notice. To file a notice, you must send an email to info@quizera.tr containing the following information: (a) description of the content for which you claim copyright ownership; (b) location of the content you claim is infringing on the platform (quiz ID, URL, etc.); (c) your contact information (name, address, phone, email); (d) legal statement that you own the copyright; (e) statement that your notice is accurate and that you are not providing false information. Quizera reviews valid notices and may remove the allegedly infringing content if deemed necessary. Accounts of users who make false or malicious notices may be terminated.

7.6 Quiz Templates

Quizera offers various quiz templates to facilitate quiz creation by users. These templates are provided only as a starting point, and Quizera is not responsible for the content or accuracy of quizzes created from templates. It is your responsibility to check and make necessary edits to the content of quizzes you create from templates.

7.7 Quiz Playing Modes

Quizera offers the ability to play quizzes in different modes (test mode, flashcard mode, live presentation mode, etc.). Quizera's liability in case of any technical issues, data loss or performance problems arising from the use of these modes is limited to the limits specified in sections 12 and 13 of this Agreement.

7.8 Push Notifications

Quizera may send push notifications through the Firebase Cloud Messaging (FCM) service. Notifications are used for the following purposes:

Notification permissions can be managed from your device settings or within the application. If you refuse notification permission, push notifications will not be sent, but the core functions of the application will remain available. Your FCM token is stored securely and is used solely for sending notifications. You can change your notification preferences at any time.

8. Third-Party Applications

The Services are integrated with Third-Party Applications that provide you with access to content, products and/or other services. The use of Third-Party Applications is optional. If you choose to enable or use any of these Third-Party Applications, your use of such Third-Party Applications will be subject to and governed by the relevant terms and conditions and privacy policies of each such Third-Party Application (including but not limited to the GIPHY Terms of Service for Users included herein). You acknowledge and represent that Quizera does not endorse any such Third-Party Application and that Quizera will not be responsible for any Third-Party Application under any circumstances, including malfunction of Third-Party Applications.

9. Account Security

As the owner of your Quizera account, you have access and control over your Quizera account and devices with access to the Service. To maintain control over the account and prevent anyone from accessing the account, you must have control over the devices used to access the Service and must not disclose the password associated with your account or (if any) payment details to anyone. You are responsible for updating and maintaining the accuracy of information you provide to us regarding your account. You are also responsible for preventing unauthorized access to and use of your account by others. We may terminate or suspend your account to protect you, Quizera or our business partners from those who commit or attempt identity theft or other fraudulent activities.

10. Data Protection and Privacy Rights

10.1 General Data Protection

Where Quizera acts as a data processor under applicable law in connection with this Agreement regarding the processing of personal data, the Data Processing Agreement will be determinative. Quizera processes and protects your personal data in accordance with our Privacy Policy.

10.2 GDPR (European Union General Data Protection Regulation) Rights

If you are located in the European Union or European Economic Area, you have the following rights under GDPR:

10.3 CCPA (California Consumer Privacy Act) Rights

If you reside in California, you have the following rights under CCPA:

10.4 Other Jurisdictions

You can contact cotyora@gmail.com to exercise your rights under the data protection laws applicable in your jurisdiction. Quizera strives to comply with applicable data protection laws in all jurisdictions.

10.5 Turkish Personal Data Protection Law (Users in Türkiye)

If you are located in Türkiye, your personal data is processed under Law No. 6698 on the Protection of Personal Data. The identity of the data controller, the purposes and legal bases of processing, the conditions for transfers abroad, your rights under Article 11 of that Law and the procedure for applying to the data controller are set out in detail in our Privacy Policy, which forms an integral part of this Agreement.

11. Duration and Termination

The Agreement remains in effect as long as you use a free or paid Quizera account. Quizera may terminate the Agreement or suspend your access to Quizera Services at any time, including cases of actual or suspected unauthorized use of Quizera Services and/or Resources or non-compliance with the Agreement. If you or Quizera terminates the Agreement or if Quizera suspends your access to Quizera in accordance with the Agreement, you agree that, to the fullest extent permitted by applicable law, Quizera has no debt or liability to you and Quizera will not refund any amounts paid up to that point.

All Licenses granted to you regarding Quizera Services and Resources and not yet terminated upon expiration of your Service Plan will terminate upon termination or expiration of the Agreement.

You acknowledge and represent that the perpetual license you grant to Quizera will continue after termination or expiration of this Agreement for any reason.

Sections of the Agreement that, by their nature or expressly, must remain in effect after termination of the Agreement will remain valid after termination.

12. Warranty and Disclaimer

We can assure you that the Services will substantially conform to the descriptions of Quizera Services and Resources as presented in our application. For all Service plans, except for Planned downtime, we will make commercially reasonable efforts to make the Services available 24 hours a day, 7 days a week. We will notify you in advance of any planned downtime that is expected to cause significant disruption. In case of any breach of Quizera's obligations under this section 12, Quizera will (i) make reasonable efforts to remedy such non-conformity and, if correction is not reasonably possible, (ii) replace all non-conforming parts of the Services and Resources. Quizera disclaims all other warranties except those set forth in the Agreement. Additionally, Quizera is in no way responsible for any Third-Party Application, including malfunctions in Third-Party Applications.

Quizera is not responsible for breaches of warranties caused by the following:

1 hardware, software or other components that are not part of the Services and Resources;

2 errors or problems caused or contributed to by hardware, software or other components not provided by Quizera, including modifications made by you or third parties;

3 errors or problems caused by your non-compliance with this Agreement;

4 if you have refused to apply any upgrade, modification, correction or similar procedure that would prevent the error or problem; and

5 errors or problems caused by third parties not acting on behalf of Quizera, including changes to the Services and Resources.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZERA, ITS AUTHORITIES, SHAREHOLDERS, EMPLOYEES, REPRESENTATIVES, MANAGERS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, AGENTS, SUPPLIERS OR LICENSORS SHALL NOT BE LIABLE FOR (1) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES; OR (2) ANY LOSS OF USE, DATA, TRADE OR PROFITS (WHETHER DIRECT OR INDIRECT) ARISING FROM THE USE OR INABILITY TO USE QUIZERA SERVICE, THIRD-PARTY APPLICATIONS OR THIRD-PARTY CONTENT, REGARDLESS OF LEGAL THEORY, REGARDLESS OF WHETHER QUIZERA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR NOT, OR EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. QUIZERA'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNTS YOU PAID TO QUIZERA DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE LAST EVENT GIVING RISE TO LIABILITY UNDER THIS AGREEMENT.

NOTHING IN THE AGREEMENT SHALL EXCLUDE OR LIMIT QUIZERA'S LIABILITY FOR FRAUD, FALSIFICATION, MISLEADING STATEMENT, DEATH OR PERSONAL INJURY CAUSED BY QUIZERA'S NEGLIGENCE OR, WHERE REQUIRED BY APPLICABLE LAW, GROSS NEGLIGENCE.

14. Apple-Specific Provisions

In addition to the above provisions and without prejudice to the Terms, this section applies to your use of any version of our application compatible with Apple's iOS communication system. Apple is not a party to these Terms and is not the owner of the application and is not responsible for the application. Apple, if any, provides no warranty for the application except to refund the purchase price for the application. Apple is not responsible for maintenance of the application or other support services, and will not be responsible for any other claims, losses, liabilities, damages, costs or expenses related to the application, including any third-party product liability claims, consumer protection or similar legislation claims, and claims related to intellectual property infringement. Any questions or complaints regarding the use of the application, including those related to intellectual property rights, should be directed to Quizera. The license granted to you in these Terms is limited to an irrevocable license to use the application on an Apple-branded product that you own or control and that runs Apple's iOS operating system, as permitted by the Usage Rules set forth in Apple's App Store Terms of Service. Additionally, you must comply with any applicable third-party terms of agreement when using the Application, such as your wireless data service agreement. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms. Without prejudice to Apple's and Apple's subsidiaries' rights, Quizera may not modify, waive or terminate any provision of these Terms.

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Quizera and its parent company and affiliates and their directors, officers, managers, employees, donors, representatives and licensors from all claims and all losses, expenses, damages and costs, including reasonable attorney fees, arising from: (1) your breach of the Agreement; (2) any User Content; (3) any activity by you or anyone using your account on Quizera or through Quizera Services; and (4) your violation of any law or third-party rights. We reserve the right to assume the exclusive defense of any claim for which we have an indemnification right under these Terms. In such a case, you must provide reasonable cooperation as reasonably requested by us.

16. Miscellaneous

16.1 Entirety of Agreement

Unless stated in this section or expressly agreed in writing between you and Quizera, the Agreement constitutes all terms and conditions agreed between you and Quizera and supersedes all previous written or oral agreements regarding the subject matter of this Agreement.

16.2 Severability and Waiver

Unless otherwise stated in the Agreement, if any provision of the Agreement is held to be invalid or unenforceable for any reason or at any level, such invalidity or unenforceability shall in no way affect or invalidate the remaining provisions of the Agreement, and such provision shall be enforced to the extent permitted by law.

Failure by Quizera or a third-party beneficiary to enforce the Agreement and any of its provisions does not constitute a waiver by Quizera or the relevant third-party beneficiary of the right to do so.

16.3 Assignment

Quizera may assign the Agreement or any part thereof, and Quizera may assign any of its obligations under the Agreement. You may not assign the Agreement or any part thereof, or transfer or license your rights under the Agreement to a third party.

17. Changes to Terms

We reserve the right to make changes to these Terms from time to time. Changes may be made, for example, to accommodate new products or services, comply with legal requirements, or better adapt the Terms to our business. If there is a significant change to these Terms, we will notify you by email to your registered email account or through in-app or in-service notifications. It is your responsibility to carefully read these notifications. Your continued use of the Services after such changes means you accept the amended Terms. If you do not wish to continue using the Service under the new version of the Terms, you may cancel your Service Plan or terminate the Agreement. We reserve the right to change the Acceptable Use Policy at any time without notice.

18. Applicable Law / Jurisdiction

18.1 Applicable Law

The Agreement is subject to Turkish statutes and laws, regardless of conflict between laws and the United Nations Convention on Contracts for the International Sale of Goods. Turkish laws will apply to all matters regarding the use of the Services and the purchase of any product or service through the Services. However, mandatory consumer protection laws in your jurisdiction prevail over the provisions of this Agreement.

18.2 Jurisdiction

All legal proceedings to enforce the Agreement will be conducted in the courts of Ankara, Turkey. You accept the jurisdiction of these courts and waive any objection to jurisdiction, venue or forum non conveniens against these courts. However, under mandatory consumer protection laws in your jurisdiction, your right to file a lawsuit in the courts of your jurisdiction is reserved.

18.3 International Use

Quizera Services are available worldwide, but the use of Services may be legally restricted in some countries or jurisdictions. Quizera accepts no responsibility if you attempt to use the Services in violation of such restrictions. It is your responsibility to use the Services in accordance with the laws of your jurisdiction.

18.4 EU Consumer Rights

If you reside in the European Union, under the EU Consumer Rights Directive, your local consumer protection laws prevail over the provisions of this Agreement. Consumers in the EU have the right to contact local consumer protection organizations.

19. Definitions

"Acceptable Use Policy" means, rather than a separate document, the acceptable use rules set out in sections 2.2 (General Rules of Use) and 6 (User guidelines) of these Terms, as updated from time to time.

"Agreement" collectively means these Terms, the Acceptable Use Policy and all Service Plans.

"Application" means Quizera's software/mobile applications.

"Apple" means Apple Inc.

"Children" means children under 13 in the US and children under 16 outside the US.

"Code" means a code or any opportunity given or sold on behalf of Quizera for access to a paid Service Plan subscription.

"Consumer" means natural persons who do not subscribe to or use the Services for commercial purposes.

"Quizera+" means the Paid Service Plan that provides access to certain special features as part of the Quizera Platform.

"Quizera Pro" means the higher-tier Paid Service Plan that provides higher usage limits than the Quizera+ plan.

In these Terms, Quizera means the service operator identified in the data controller section of the Privacy Policy.

"Quizera Brands" means all trademarks, service marks, trade names, logos and other features of the Quizera brand.

"License" means the license granted to you in section 3 of these Terms.

"Platform" means Quizera's Applications where Quizera Services are provided.

"Public User Content" means User Content that the User chooses to make publicly available by activating the "publish" button, such as Quizera games/quizzes, based on certain User Content of some Quizera Services and depending on users contributing content to the Service.

"Resources" means information, resources, services, products and tools provided to you in Quizera Services.

"Service Plan" means the various subscription plans through which Quizera Services are accessed.

"Services" means Quizera services, including all software, that you subscribe to under these Terms.

"Subscription Period" means the duration of the relevant Service Plan.

"Terms" means these general terms and conditions applicable to your use of Quizera Services.

"Trial" means free or discounted trials of paid Service Plan subscriptions for a certain period.

"User Content" means content and data uploaded by Users to the Service, including but not limited to tests, images, videos, texts, messages, information, user feedback and other content.
